US Supreme Court Strikes Down IEEPA Tariffs: Major Impact on Trump's Trade Policy

In a landmark decision on February 20, 2026, the US Supreme Court ruled that the President cannot use the International Emergency Economic Powers Act (IEEPA) to impose trade tariffs. This ruling was a major blow to the Trump administration's trade strategy, which had relied on IEEPA as the primary legal basis for tariff imposition. The Court of International Trade also declared Proclamation 11012, which imposed Section 122 tariffs, invalid on May 7, 2026. In response, the Trump administration is now turning to Section 301 investigations targeting China's industrial overcapacity and forced labor violations, as well as Section 232 tariffs as alternatives. Global industries and businesses are now awaiting clarity on the new trade policy framework being shaped by the Trump administration to replace the struck-down IEEPA tariff structure.
